Terms of Service

Welcome to Besito. These Terms are a legal agreement between you and Pankaj Sengar, an individual, of 8A Gold Souk Mall, Sector 43, Gurugram (Gurgaon), Haryana 122002, India ("Besito", "we", "us") for your use of the Besito app, besito.in and related services (the "Service"). Each section starts with a short plain-language note in italics; the full text is what applies.

1. Accepting these Terms

By using Besito you agree to these Terms and the policies they mention.

By creating an account or using the Service you accept these Terms, our Privacy Policy, Community Guidelines, Child Safety Standards and Safe Dating Tips, which form part of this agreement. If you don't agree, don't use Besito.

2. Who can use Besito

Adults only, one account each, and nobody with a history of sexual or violent crime.

• You must be at least 18 years old and legally able to enter this agreement.
• You must not have been convicted of, or be required to register as a perpetrator of, a sexual offence or a violent crime.
• You must not be barred from using the Service under Indian law, and must not have been banned from Besito before.
• You may have only one account, and it is for your own personal, non-commercial use.

3. Your account

Be honest about who you are and keep your login safe.

Keep your information true and up to date, and use photos of yourself only. You sign in with Google, so keep your Google account secure; you're responsible for activity on your Besito account. Tell us at support@besito.in if you think someone else has accessed it.

4. Community rules

Be kind, be real, and respect people's yes and no, online and offline.

You agree to follow our Community Guidelines. In particular, you must not:

• impersonate anyone, use fake photos or misrepresent your age, identity or relationship status;
• harass, threaten, stalk, bully, intimidate, shame or abuse anyone, on or off Besito;
• send sexual content to someone who hasn't clearly agreed to receive it, or any content involving a minor;
• post content that is hateful, violent, obscene, defamatory, illegal or that infringes anyone's rights;
• use Besito for commercial purposes: advertising, selling, sex work or escort services, recruiting, or promoting other apps;
• ask other members for money, gifts, investments or financial details, or run scams of any kind;
• use another member's location or information to find or approach them without their agreement (a hi on Around You is not permission to walk up to someone);
• scrape, copy or automate access to the Service, reverse-engineer the app, or interfere with its security;
• share other members' photos, messages or personal information outside Besito without their permission.

5. Content

You're responsible for what you post; other members are responsible for theirs; Besito's own content belongs to us.

Your content. You're responsible for the photos, text and audio you add, and you confirm you have the right to share them and that they follow these Terms and the law. Don't include other people's personal contact details, or your own, in your public profile.

Other members' content belongs to them. Besito doesn't check everything members post and isn't responsible for it, but we act on reports (see section 6).

Our content. The Besito name, logo, app, designs, text and graphics belong to Besito or our licensors. Don't use them without our written permission.

6. Reporting and enforcement

Report anything wrong; we review it and may remove content or accounts.

Report a member or content from their profile or your chat (menu → Report), or email support@besito.in. Our team reviews reports and may look at relevant profiles, content and messages. We may remove content, limit features (for example pausing Around You for someone whose requests keep being ignored), or suspend or permanently ban accounts that break these Terms, with or without notice. As an intermediary under the IT Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we remove unlawful content when required and report illegal activity to the authorities.

7. Privacy

How we handle your data is explained in our Privacy Policy.

Please read our Privacy Policy. It explains what data we collect, why, and the rights you have under the DPDP Act, 2023.

8. Rights we give you

You may use the app for personal dating, as long as you follow these Terms.

We give you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable licence to use the Service as we intend it, while you comply with these Terms. This licence ends if you break them.

9. Rights you give us

You still own your content; you let us use it to run Besito.

You own your content. You give Besito a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, display, reproduce, adapt (for example resize or blur photos) and distribute it, only to operate, improve and keep the Service safe, for as long as your content is on Besito. We won't use your photos in advertising without asking you first.

10. Purchases and subscriptions

Plus renews automatically until you cancel in Google Play; Boosts are one-time purchases.

• Besito Plus is an auto-renewing subscription (1 week, 1 month, 3 months or 6 months) sold through Google Play at the price shown before you buy. It renews at the end of each period unless you cancel at least 24 hours before, in Google Play → Payments & subscriptions → Subscriptions. After cancelling, you keep Plus until the end of the paid period.
• Boosts are one-time purchases. Each Boost puts your profile at the top of Discover nearby for 24 hours once you start it. Unused Boosts don't expire while your account is active but can't be transferred or exchanged for money.
• Billing and refunds are handled by Google Play under its terms and refund policy. Deleting your Besito account does not cancel a Google Play subscription.
• We may change features or prices; Google Play will tell existing subscribers about a price change before it applies.
• If we ban an account for breaking these Terms, unused paid time and Boosts aren't refunded, unless the law requires it.

11. Ending your account

You can leave any time; we can end accounts that break the rules.

Delete your account any time in Profile → Settings & privacy → Delete account, or see besito.in/delete-account. We may suspend or terminate your account under section 6. Sections that by their nature should survive (such as 5, 9, 13, 16, 17 and 18) continue after your account ends.

12. No background checks

We verify that faces match photos, not who people really are. Stay careful.

Besito doesn't run criminal background checks or verify members' identity documents. Selfie verification only confirms that a member resembles their photos. You're responsible for your interactions with other members. Read our Safe Dating Tips, meet in public, and never send money to someone you met on Besito.

13. Disclaimer

We do our best, but the app comes as it is.

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind. We don't promise that you'll find a match, that the Service will always be available or error-free, or that members are who they say they are. We may change, pause or stop any part of the Service.

14. Copyright complaints

If someone posted your work without permission, tell us and we'll act.

If you believe content on Besito infringes your copyright, email support@besito.in with: your contact details; a description of the work; where it appears on Besito; a statement that you own the rights (or act for the owner) and that the use isn't authorised; and your signature. We act on valid notices under the Copyright Act, 1957 and the IT Rules, and may remove the content and ban repeat infringers.

15. Third-party services

Links and services from others are their responsibility.

The Service may link to or use third-party services such as Google Maps, Google Play and date spot websites. We're not responsible for them, and their own terms apply.

16. Limitation of liability

Our liability is limited, as far as the law allows.

To the extent the law allows, Besito isn't liable for indirect, incidental, special or consequential losses, loss of data or profits, or for the conduct of any member on or off the Service. Our total liability for any claim is limited to what you paid us in the 12 months before the claim, or ₹1,000 if that is more. Nothing here limits liability that can't be limited under Indian law.

17. Indemnity

If you break the rules and we get sued for it, you cover the cost.

You agree to compensate Besito and its team for any claims, losses and reasonable legal costs arising from your breach of these Terms, your content, or your conduct with other members.

18. Disputes and governing law

Talk to us first; Indian law applies.

If you have a problem, please contact us first so we can try to resolve it informally within 30 days. These Terms are governed by the laws of India, and courts at Gurugram, Haryana have exclusive jurisdiction. This doesn't take away any rights you have as a consumer under the Consumer Protection Act, 2019.

19. Changes and other terms

If we update these Terms we'll tell you.

We may update these Terms. We'll post the new version here and, if the change is significant, tell you in the app before it takes effect; continuing to use Besito means you accept it. These Terms are the entire agreement between you and Besito about the Service. If a part is found unenforceable, the rest still applies. If we don't enforce a term, we haven't given up the right to. You can't transfer these Terms; we may transfer them to a successor of the business.

Complaints about content or accounts are acknowledged within 24 hours and resolved within 15 days, as required by the IT Rules, 2021.
